🛒 GENERAL TERMS AND CONDITIONS OF SALE

Article 1 — Identification of the Seller

These General Terms and Conditions of Sale ("GTCS") govern all sales of products made through the website timelens.co by:

TimeLens® is a registered trademark of TimeLens SAS.


Article 2 — Scope & Acceptance

These GTCS apply to all orders placed by any customer ("Customer," "you") on timelens.co, whether the Customer is a consumer (purchasing for personal use) or a professional (purchasing for business purposes).

By placing an order on timelens.co, you unconditionally accept these GTCS in their entirety. These GTCS constitute the entire agreement between TimeLens and the Customer regarding the sale of products, and supersede any prior communications, representations, or agreements.

TimeLens reserves the right to modify these GTCS at any time. The version applicable to any order is the one in effect on the date the order is placed.


Article 3 — Products

3.1 Product Description

TimeLens makes every reasonable effort to ensure that product descriptions, photographs, and technical specifications on timelens.co are accurate and up to date. However, minor variations in color, appearance, or specifications may occur and do not constitute a valid reason for cancellation or return, except where such variations materially affect the use or value of the product.

3.2 Product Availability

All products are offered for sale subject to availability. In the event that a product becomes unavailable after an order has been placed:

  • TimeLens will notify the Customer by email within 3 business days
  • The Customer will be offered the choice of a substitute product of equivalent value, a store credit, or a full refund
  • If no response is received within 7 days, TimeLens will issue a full refund automatically

3.3 Product Compliance

TimeLens® cameras sold on timelens.co comply with applicable regulations in the countries where they are sold. It is the Customer's responsibility to ensure that the product is permitted for import and use in their country of residence.


Article 4 — Pricing

4.1 Currency & Taxes

All prices displayed on timelens.co are expressed in US Dollars (USD) unless otherwise indicated at checkout. Prices are shown exclusive of applicable taxes unless otherwise stated.

  • US Customers: applicable state and local sales tax will be added at checkout where TimeLens has tax nexus.
  • International Customers: prices shown exclude customs duties, VAT, and import taxes which may be levied by the destination country. These charges are the sole responsibility of the Customer.

4.2 Price Changes

Prices may be updated at any time without prior notice. The price applicable to an order is the price displayed on timelens.co at the time the Customer places the order. Price changes after an order has been confirmed do not apply to that order.

4.3 Promotional Prices

Promotional prices and discount codes are valid only during the stated promotional period and subject to the specific conditions attached to each promotion. Only one discount code may be applied per order unless otherwise specified.

4.4 Pricing Errors

In the event of an obvious pricing error (including but not limited to prices that are manifestly incorrect or result from a technical error), TimeLens reserves the right to cancel any order placed at an erroneous price, even after a confirmation email has been sent. In such cases, the Customer will be notified promptly and a full refund will be issued.


Article 5 — Order Process

5.1 Placing an Order

To place an order on timelens.co, the Customer must:

  1. Select the desired product(s) and add them to the cart
  2. Provide accurate shipping and billing information
  3. Select a shipping method
  4. Select a payment method and enter payment details
  5. Review the order summary and confirm by clicking "Place Order" or equivalent

By clicking the order confirmation button, the Customer acknowledges having read and accepted these GTCS.

5.2 Order Confirmation

Upon receipt of the order, TimeLens will send an order confirmation email to the email address provided by the Customer. This email constitutes acknowledgment of receipt of the order but does not constitute acceptance of the order.

The sale is considered final and the contract formed when TimeLens sends a shipping confirmation email containing a tracking number.

5.3 Order Modification or Cancellation by the Customer

Orders may be modified or cancelled within 1 hour of placement by contacting contact@timelens.fr. After this period, orders may already be in processing and cancellation cannot be guaranteed. If the order has already shipped, the Customer must follow the return procedure outlined in our Return & Refund Policy.

5.4 Order Modification or Cancellation by TimeLens

TimeLens reserves the right to cancel or refuse any order in the following circumstances:

  • The product is out of stock
  • The order contains an obvious pricing error
  • Payment cannot be verified or is declined
  • The order appears to be fraudulent or in violation of these GTCS
  • The Customer has previously breached these GTCS
  • Export restrictions or sanctions apply to the delivery country

In such cases, the Customer will be notified and any payment made will be fully refunded.


Article 6 — Payment

6.1 Accepted Payment Methods

TimeLens accepts the following payment methods on timelens.co:

  • Visa, Mastercard, American Express, Discover (credit and debit cards)
  • PayPal
  • Apple Pay
  • Google Pay
  • Shop Pay

6.2 Payment Security

All payment transactions are processed through secure, PCI-DSS compliant payment processors. TimeLens does not store full credit card numbers on its servers. All data transmitted during payment is encrypted via SSL/TLS technology.

6.3 Payment Timing

Payment is due and collected in full at the time the order is placed. TimeLens does not offer deferred payment, installment payment plans, or credit terms unless explicitly stated on the product page.

6.4 Payment Verification & Fraud Prevention

TimeLens uses automated and manual fraud detection measures. In the event of suspected fraud, TimeLens reserves the right to:

  • Request additional verification from the Customer (proof of identity, billing address confirmation)
  • Place the order on hold pending verification
  • Cancel the order and issue a full refund

The Customer will be notified by email if additional verification is required.

6.5 Failed Payment

If payment is declined or cannot be processed, the order will not be confirmed and no items will be shipped. The Customer will be notified and may retry with a different payment method.


Article 7 — Delivery

7.1 Delivery Address

TimeLens delivers to the address provided by the Customer at checkout. The Customer is solely responsible for ensuring that the delivery address is accurate and complete. TimeLens cannot be held responsible for delivery failures resulting from an incorrect or incomplete address provided by the Customer.

7.2 Processing & Shipping Times

Orders are processed within 1–3 business days after payment confirmation. Estimated delivery times are:

Delivery times are estimates only and are not guaranteed. TimeLens shall not be liable for delays caused by carriers, customs authorities, or other circumstances beyond its control.

7.3 Transfer of Risk

Risk of loss and damage to the products transfers to the Customer upon delivery of the products to the carrier. Once a shipment has been handed over to the carrier and a tracking number issued, TimeLens's direct responsibility for the physical condition of the product during transit ends.

7.4 Transfer of Title

Legal title (ownership) of the products transfers to the Customer upon full receipt of payment.

7.5 Delivery Failures

If a delivery attempt fails and the package is returned to TimeLens, we will contact the Customer. A reshipping fee may apply. If the Customer does not respond within 14 days, the order may be refunded minus original shipping costs.


Article 8 — Right of Withdrawal (EU & UK Customers)

8.1 Cooling-Off Period

Customers in the European Union and United Kingdom have the right to withdraw from the contract within 14 days of receiving the product, without giving any reason, in accordance with:

  • EU Directive 2011/83/EU on Consumer Rights
  • UK Consumer Rights Act 2015 and Consumer Contracts Regulations 2013

TimeLens extends this right to 30 days for all customers worldwide as part of our Return & Refund Policy, which is more favorable than the legal minimum.

8.2 Exercising the Right of Withdrawal

To exercise the right of withdrawal, the Customer must notify TimeLens before the withdrawal period expires by emailing contact@timelens.fr with a clear statement of their decision to withdraw, including the order number.

8.3 Effects of Withdrawal

Upon valid exercise of the right of withdrawal:

  • The Customer must return the product within 14 days of notifying TimeLens
  • TimeLens will issue a full refund, including standard outbound shipping costs, within 14 days of receiving the returned product or proof of return shipment, whichever is earlier
  • The Customer is responsible for the direct cost of returning the product (except where TimeLens provides a prepaid label)
  • The Customer is liable for any diminished value of the product resulting from handling beyond what is necessary to determine its nature, characteristics, and functioning

8.4 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Products that have been personalized or custom-made
  • Products that have been unsealed and used where return is unsuitable for health or hygiene reasons (if applicable)

Article 9 — Legal Guarantees (EU & UK Customers)

9.1 Legal Guarantee of Conformity (EU)

In accordance with EU Directive 2019/771, EU customers benefit from a 2-year legal guarantee of conformity from the date of delivery. During this period, any lack of conformity that becomes apparent within the first year is presumed to have existed at the time of delivery.

If a product does not conform to the contract, the Customer is entitled to:

  • Repair or replacement of the product (free of charge, within a reasonable time, without significant inconvenience)
  • A price reduction or full refund if repair/replacement is impossible, disproportionate, or not completed within a reasonable time

9.2 Legal Guarantee Against Hidden Defects (France — applicable as seller's home jurisdiction)

TimeLens provides the legal guarantee against hidden defects as provided by applicable French law (Articles 1641 to 1649 of the French Civil Code). If a hidden defect renders the product unfit for its intended use, the Customer may choose between returning the product for a full refund or keeping the product with a partial refund.

9.3 Commercial Warranty

In addition to legal guarantees, TimeLens offers a 1-year limited commercial warranty on all TimeLens® products against defects in materials and workmanship under normal use. See our Limited Warranty document for full details.


Article 10 — Liability

10.1 TimeLens's Liability

TimeLens's liability under these GTCS is limited to direct damages actually suffered by the Customer and shall not exceed the total amount paid by the Customer for the product(s) giving rise to the claim.

TimeLens shall not be liable for:

  • Indirect, incidental, special, punitive, or consequential damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages resulting from the Customer's misuse of the product
  • Damages caused by third parties, including carriers
  • Damages resulting from events of force majeure

10.2 Customer's Responsibility

The Customer is responsible for ensuring that the product is appropriate for their intended use, that they have the technical knowledge required to operate the product safely, and that use of the product complies with all applicable laws in their jurisdiction.

10.3 Force Majeure

TimeLens shall not be held liable for any delay or failure in performance resulting from events beyond its reasonable control, including but not limited to: natural disasters, pandemics, acts of government, strikes, wars, supply chain disruptions, or telecommunications failures. In such cases, TimeLens will notify the Customer promptly and performance will be suspended for the duration of the force majeure event.


Article 11 — Intellectual Property

All content on timelens.co — including but not limited to the TimeLens® trademark, logos, product designs, photographs, text, and software — is the exclusive property of TimeLens SAS and is protected by applicable intellectual property laws.

No content may be reproduced, distributed, modified, displayed, or used without the prior written consent of TimeLens SAS. Any unauthorized use may violate trademark, copyright, and other applicable laws.


Article 12 — Personal Data

TimeLens collects and processes personal data in connection with orders placed on timelens.co. This processing is governed by our Privacy Policy, which forms an integral part of these GTCS and is available at timelens.co.

By placing an order, the Customer acknowledges having read and accepted the Privacy Policy.


Article 13 — Applicable Law & Jurisdiction

13.1 Governing Law

These GTCS are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions, for customers in the United States and internationally (excluding the EU and UK).

For EU customers, mandatory consumer protection provisions of the law of the Customer's country of residence apply and are not waived by these GTCS.

For UK customers, the laws of England and Wales apply to the extent mandatory consumer protections require it.

13.2 Dispute Resolution — US Customers

In the event of a dispute, the Customer agrees to first attempt informal resolution by contacting contact@timelens.fr. If informal resolution fails after 30 days, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA), on an individual basis. Class action waiver applies.

13.3 Dispute Resolution — EU Customers

EU customers who are consumers may submit disputes to the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr

EU customers also retain the right to bring proceedings before the competent courts of their country of residence.

13.4 Dispute Resolution — UK Customers

UK customers may contact the Citizens Advice Bureau or refer disputes to an approved Alternative Dispute Resolution (ADR) entity.


Article 14 — Entire Agreement & Severability

These GTCS, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, Cookie Policy, and Limited Warranty, constitute the entire agreement between TimeLens and the Customer regarding the purchase of products on timelens.co.

If any provision of these GTCS is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.
